The State Ministry of Health has published an order that will modify the previous emergency regulations which came into force on 13th April concerning construction and building work, translation below

The possibility of doing works in homes and premises or in other uninhabited defined areas is expanded, as well as those in which residents do not have access

Depending on the evolution of the health situation, the remaining restrictions may be eliminated through the corresponding modification of this Order

The Ministry of Health has published today in the Official State Bulletin (BOE) a Ministerial Order that modifies Order SND / 340/2020, of April 12, by which the execution of certain activities related to intervention works in existing buildings in which there is a risk of contagion by COVID-19 for people not related to said activity.

The evolution of the health crisis that develops in the context of the state of emergency, forces continuous adaptation and specification of the measures adopted to ensure efficiency in crisis management.

Within this framework, it has been necessary to modify Order SND / 340/2020 in order to include other exceptional actions of the suspension, which were previously regulated, and which are the following:

  • The works that are carried out in premises, houses or other defined areas of the building that are not inhabited, or to which residents do not have access while the works last, provided that all the following conditions are met:

    The movement of workers and materials through common non-site areas is limited and all appropriate measures are taken to avoid contact with the residents of the property during the course of the day.

    The access and exit of those premises, houses or areas, occur at the beginning and at the end of the working day.

    Workers adopt the prevention and hygiene measures against COVID-19 indicated by the health authorities.

  • Likewise, in all the excepted cases, access to non-site areas of the building is allowed, for the performance of specific operations to connect with the building’s service networks that are necessary to undertake the works.

Until now, these works could only be carried out in the event that the areas of required access to homes or premises were within the worksite.

This Order will remain in force until the end of the emergency period and its extensions or until there are public health circumstances that justify the approval of a new Order that modifies the terms of this.
